RESOLUTION OF THE SOUTH SALEM FIRE DISTRICT
TO PURCHASE A NEW CHIEF’S VEHICLE

WHEREAS, the South Salem Fire District Board of Fire Commissioners (“Board”) believes that it would be in the best in interests of the residents of the South Salem Fire District (“Fire District”) to purchase a new Chief’s Vehicle (“Vehicle”), in order to meet the needs of the Fire District;

WHEREAS, the Board has reviewed sealed bids received November 14th, and has determined that such bid price offered by Smithtown Chevrolet was the lowest price and was reasonable and of best value, and has determined it is in the best interests of the Fire District to purchase the Vehicle to be used as a Chief’s vehicle for the Fire District, and the total price for the Vehicle, with the exception of certain unidentified additions or change orders, should not exceed $50,000.00;

WHEREAS, sufficient reserve funds have been saved to purchase the Vehicle, that being $50,000.00, which currently reside in a capital reserve fund for vehicle purchases;

WHEREAS, the Board has evaluated alternatives for financing, and in that evaluation has reviewed the cost of the purchase and has made a recommendation to utilize funds from capital reserve fund, rather than incur indebtedness, up to the amount of $50,000;

NOW, THEREFORE, THE BOARD OF FIRE COMMISSIONERS OF THE SOUTH SALEM FIRE DISTRICT IN THE TOWN OF SOUTH SALEM, WESTCHESTER COUNTY, NEW YORK (THE “DISTRICT”) HEREBY RESOLVES (by the favorable vote of not less than three-fifths of all its members), AS FOLLOWS:

SECTION 1. The Fire District is hereby authorized to purchase a 2023 Chevrolet Tahoe for use as a Chief’s Vehicle, for the maximum anticipated cost of $50,000.00, utilizing up to $50,000 from the capital reserve fund for vehicle purchases;

SECTION 2. The District has determined that the lowest bid from Smithtown Chevrolet is authorized by GML §103(16) to meet the needs of the Fire District;

SECTION 3. The District officers, including the chairperson, are hereby authorized to take such actions and execute such documents as may be necessary to arrange for the purchase the Vehicle in the total amount of up to $50,000.00, and to use up to $50,000 from the capital reserve fund for vehicle purchases, left to the discretion of the board of fire commissioners. The funds may be withdrawn from the reserve fund in various amounts at the discretion of the Chair.
SECTION 4. This resolution shall be subject to a permissive referendum.

This resolution was approved by a majority of the Commissioners, on the 14th day of November, 2022.

ABSTRACT

By resolution dated November 14, 2022, the South Salem Fire District has approved a resolution, subject to permissive referendum, to withdraw up to $50,000.00 from the capital reserve fund for vehicle purchases for the purchase of a vehicle to be used as a Chief’s Vehicle. Any person wishing to subject this resolution to a mandatory referendum must submit a proper petition to the District’s secretary within thirty (30) days of the date of this resolution.
